The above-captioned matter was heard as a contested case on July 9, 2002, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.
After extensive discussion, the parties entered an agreement wherein the respondent agreed to provide the complainant with access to inspect all vendor financial records maintained by the respondent in paper form for the fiscal years of 1999 through 2002 and to inspect on a computer screen all vendor financial records maintained by the respondent in his database for the fiscal years of 1995 through 2002, in that order. A town employee will be present and the complainant may be accompanied by one other person during his inspection of the records. The parties agreed that the complainant may appear at the respondent’s office for such inspection on Fridays at 10 a.m. and will provide the respondent with at least two days notice.
After reaching the above agreement, the complainant stated that he wished to withdraw his complaint. The Commission commends all parties for their efforts in resolving their earlier differences.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.
1. The complaint is hereby dismissed.
