The above-captioned matter was scheduled to be heard as a contested case on October 4, 2002, at which time the complainant and the respondents appeared to present testimony, exhibits and argument on the complaint. At an informal conference prior to the October 4, 2002 hearing, the complainant and the respondents reached the terms of an agreement in resolution of this contested case.
The complainant and the respondents have agreed that: 1) by October 22, 2002, complainant will make a $20 prepayment to the respondents for copying charges; 2) by October 29, 2002, respondents will furnish pages one and three of the employment applications of all persons who had a criminal record and were hired by respondents as full time or part time teachers during the years 1999, 2000, 2001 and 2002 to date, and will also furnish copies of any criminal record information that accompanied such applications; 3) by December 2, 2002, complainant will make an additional $30 prepayment to the respondents for copying charges; and 4) by December 31, 2002, respondents will furnish pages one and three of the employment applications of all persons who had a criminal record and were hired by respondents as substitute teachers during the years 1999, 2000, 2001 and 2002 to date, and will also furnish copies of any criminal record information that accompanied such applications.
Based upon this agreement, the complainant agreed to withdraw his complaint.
The Commission warmly commends both the complainant and the respondents for working successfully to negotiate a non-litigated settlement of their earlier differences. The Commission accepts the agreed upon schedule, for the search to satisfy a revised request for records, because of the budget constraints, including layoffs, currently in effect in the City of Bridgeport.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
