Pursuant to an October 10, 2001 order of the Freedom of Information Commission, this matter was reopened to determine the appropriateness of assessing a civil penalty against Dorothy Guman, Acting Chairperson, Planning and Zoning Commission, City of Bridgeport, pursuant to §1-206(b)(2), G.S. Accordingly, a hearing was held on December 21, 2001, at which time the complainant and the respondent appeared and presented evidence and argument on such issue.
After consideration of the entire record, the following facts are found and conclusions of law are reached:
1. The respondent is a public agency within the meaning of §1-200(1), G.S.
2. It is found that the respondent’s failure to respond to the complainant’s records request and her failure to appear at the initial August 28, 2001 hearing in this matter were the result of a genuine mistake.
3. It is found that the complainant has been provided with the records it requested. It is further found that the complainant does not seek the imposition of a civil penalty in this matter.
4. It is concluded that a civil penalty pursuant to §1-206(b)(2), G.S., is not warranted under the facts and circumstances of this case.
On the basis of the record concerning the above-captioned complaint, no order by the Commission is hereby recommended.
