The above-captioned matter was scheduled to be heard as a contested case on November 5, 2002, at which time the complainants and respondent appeared. For purposes of hearing, this case was consolidated with Docket #FIC 2002-377; Rick Guinness and Journal Inquirer v. Stafford Wall of Honor Advisory Committee, Town of Stafford. At the hearing in this matter, the parties informed the Commission that they had reached the following terms, in resolution of this case:
1. The respondent shall forthwith provide the complainants with a copy of the military discharge papers that were at issue in this matter, in accordance with the provisions of Public Act No. 02-137.
2. In consideration of the foregoing, the complainants withdrew their complaint in this matter.
The following order by the
Commission is hereby recommended on the basis of the record concerning the
above-captioned complaint:
1. The complaint is hereby
dismissed.
2. The Commission commends
all parties for reaching a non-litigated settlement of this matter.
