The above-captioned matter was scheduled to be heard as a contested
case on October 30, 2002, at which time the complainant and the respondent
appeared to present testimony, exhibits and argument on the complaint. At an
informal conference prior to the October 30, 2002 hearing, the complainant and
the respondent reached the terms of an agreement in resolution of this
contested case.
Pursuant to
the terms of this agreement, the hearing was opened and the respondent’s
agent provided testimony under oath concerning the application of the Norwalk
Community College for its Hotel/Motel Management Program. Based upon the
provision of this sworn testimony, the complainant agreed to withdraw his
complaint.
The Commission warmly commends both the complainant and the respondent
for working successfully to negotiate a non-adversarial settlement of this
case. The Commission also encourages the parties to continue improving their
communication, in order to attempt a similar settlement of the adversarial
proceedings now pending in other forums.
The following order by the Commission is hereby recommended on the
basis of the record concerning the above-captioned complaint:
1. The complaint is hereby
dismissed.
