The above-captioned matter was heard as a contested case on May 10, 2002, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. 

During the hearing on this matter, the respondent agreed to provide the complainant with the requested rating notices from each of the four doctors providing such ratings, for the period between January 1, 2001 and May 10, 2002.  In addition the respondent agreed to provide the complainant with all other non-exempt documents in the complainant’s file.  The complainant agreed to pay one hundred and fifty dollars ($150.00).  The complainant further agreed to withdraw his complaint in this matter and to not file any additional Freedom of Information complaints against the respondent regarding his workers’ compensation claim pending at the time of this complaint.

 

The following order by the Commission is hereby recommended on the basis of

the record concerning the above-captioned complaint:


 


               1.  The complaint is hereby dismissed.
