            The above-captioned matter was scheduled to be heard as a contested case on January 17, 2003, at which time the complainants and the respondent appeared. At an informal conference held after opening the January 17, 2003 hearing, the complainants and the respondent reached the terms of an agreement in resolution of this contested case.

 

The parties agreed that: 1) the respondent regrets not permitting the members of the public (including the complainants) to accompany the respondent on a site tour of the RHAM High School/RHAM Middle School building project on August 29, 2002; 2) the respondent agrees to permit complainants and other members of the public to attend future site tours sponsored by the respondent for its entire membership, subject only to limitations reasonably necessary to satisfy physical and safety concerns; and finally, 3) the complainants informed the Commission that, as part of this agreement, they wished to withdraw their complaint.

 

            The Commission warmly commends both the complainants and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.
