The above-captioned matter was heard as a contested case on November 12, 2002, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. During the course of the hearing, the parties reached the following terms, in resolution of this case:
1. Forthwith, the respondent shall again search his records to determine the owner of record of a red four door 1992 Pontiac, plate number BLZ-681, which was towed by York Towing in New Haven on February 24, 1992. Forthwith, the respondent shall also again search his records to determine to whom such vehicle was released.
2. To the extent that the respondent keeps on file or maintains the records described in paragraph 1, above, he shall release them to the complainant forthwith. To the extent that the respondent does not keep on file or maintain such records, he shall so inform the complainant by affidavit forthwith.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Forthwith, the respondent shall again search his records to determine the owner of record of a red four door 1992 Pontiac, plate number BLZ-681, which was towed by York Towing in New Haven on February 24, 1992. Forthwith, the respondent shall also again search his records to determine to whom such vehicle was released.
2. To the extent that the respondent keeps on file or maintains the records described in paragraph 1, above, he shall release them to the complainant forthwith. To the extent that the respondent does not keep on file or maintain such records, he shall so inform the complainant by affidavit forthwith.
3. The respondent shall file with this commission within 10 days of the notice of final decision in this case an affidavit evidencing compliance with paragraphs 1 and 2 of this order.
