The above-captioned matter was heard as a contested
case on November 21, 2002, at which time the complainants and the respondent
appeared, stipulated to certain facts and presented testimony, exhibits and
argument on the complaint.
After the hearing on this matter, the parties
resolved the complaint by entering into an agreement that is outlined in a
letter dated December 12, 2002, to the complainant’s attorney from the
respondent’s attorney, following which the complainant withdrew the
complaint. The Commission
commends all the parties for their efforts in resolving their earlier
differences.
The
following order by the Commission is hereby recommended on the basis of the
record concerning the above-captioned complaint.
1. The complaint is hereby dismissed.
