            The above-captioned matter was scheduled to be heard as a contested case on February 19, 2003, at which time the complainants and the respondent appeared in order to present testimony and argument on the complaint. At an informal conference immediately following the commencement of the February 19, 2003 hearing, the complainants and the respondent reached the terms of an agreement in resolution of this contested case, wherein the parties agreed that:

 

1)  through a series of events, the respondent violated §1-225(d), C.G.S., by failing to file the notice of its special meeting of August 27, 2002 “not less than twenty-four hours prior to the time of the special meeting”;  

 

2)  the respondent violated §1-225(a), C.G.S., by not filing, within seven days, minutes for its meeting of August 27, 2002, but that the respondent will now reconstruct and file such minutes by February 27, 2003;

 

3)  counsel for the respondent, with the assistance of the staff of the Freedom of Information Commission, will conduct a Freedom of Information Act instructional session within sixty days for relevant officials of the Town of Wolcott.

 

Based upon this agreement, the complainants informed the Commission that they wished to withdraw their complaint. The Commission warmly commends both the complainants and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.
