FREEDOM OF INFORMATION COMMISSION
OF THE STATE OF CONNECTICUT

            The above-captioned matter and Docket #FIC 2002-457 were scheduled to be heard as consolidated contested cases on March 4, 2003, at which time the complainant and the respondent in the above captioned matter appeared. At an informal conference held after the opening of the March 4, 2003 hearing, the complainant and the respondent reached the terms of an agreement in resolution of this contested case.

 

The parties agreed that: 1) as a result of administrative oversight, some records requested on September 13, 2002 were not produced until March 4, 2003; 2) the remaining requested records were produced for the complainant at the hearing, except for relevant legal invoices which would be transmitted by facsimile to the complainant, with redactions of information exempt from mandatory disclosure, by 4 pm, March 5, 2003; and finally, 3) the complainant informed the Commission that, as part of this agreement, and provided that the relevant legal invoices are produced as set forth herein, he wished to withdraw his complaint.

 

            The Commission warmly commends both the complainant and the respondent for working successfully to negotiate a non-litigated settlement of their earlier differences.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.
