The above-captioned matter was scheduled to be heard as a contested case at 1 P.M. on May 5, 2003, at which time counsels for the complainant and respondent appeared. For purposes of hearing, this matter was consolidated with Docket #FIC2002-279; Julia Kish v. Department of Planning and Zoning, Town of Stratford. At such time, counsel for the complainant withdrew the complaint herein, without prejudice. Counsel for the complainant also withdrew, without prejudice, the complaint in Docket #FIC2002-324; New England Telecommunications, Inc. v. Office of the Town Manager, Town of Stratford [hereinafter “Docket #FIC2002-364”]. The hearing in Docket #FIC2002-364 was scheduled for later in the day on May 5, 2003, and counsel for the complainant herein is counsel of record for the complainant in such matter.
The following order by the
Commission is hereby recommended on the basis of the record concerning the
above-captioned complaint:
1. The complaint is hereby
dismissed.
2. The Commission commends
both parties for reaching a non-litigated settlement of this matter.
