The above-captioned matter was heard as a contested
case on February 10, 2003, at which time the respondents appeared at the
appointed time to presented testimony, exhibits and argument on the complaint.
The complainant failed to appear.
The following order
by the Commission is hereby recommended on the basis of the record concerning
the above-captioned complaint.
1. The complaint is hereby dismissed with prejudice for failure to prosecute.
2. The Commission wishes to admonish the complainant for his failure to notify the Commission, before the time of the hearing in this matter, that he wished to withdraw his complaint, which failure resulted in a waste of valuable state resources.
