The above-captioned matter was heard as a contested case on May 27, 2003 and June 30, 2003, at which times the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. This case was consolidated for hearing with docket #FIC 2003-055, Robert Mack v. Director, State of Connecticut, Department of Correction, Labor Relations.
After consideration of the entire record, the following facts are found and conclusions of law are reached:
1. The respondent is a public agency within the meaning of §1-200(1), G.S.
2. By letter received and filed August 29, 2002, the complainant appealed to the Commission, alleging that the respondent violated the Freedom of Information (“FOI”) Act by failing to provide the information he requested.
3. It is found that the complainant by letter dated August 22, 2002 requested that the respondent director of personnel provide the personnel file of Department of Correction (“DOC”) employee Shawn Samuel-Reid.
4. The issue of the disclosure of Samuel-Reid’s personnel file is fully raised, discussed and decided in the consolidated case, docket #FIC 2003-055, Robert Mack v. Director, State of Connecticut, Department of Correction, Labor Relations.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1 The complaint is dismissed.
