The above-captioned matter was heard as a contested case on July 16, 2003, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  This matter was consolidated for the purposes of hearing with Docket #FIC 2002-539, John C. King v. Agricultural Land Preservation Advisory Commission, Town of South Windsor; Docket #FIC 2002-541, John C. King v. Building Department, Town of South Windsor; Docket #FIC 2002-542, John C. King v. Economic Development Commission, Town of South Windsor; Docket #FIC 2002-543, John C. King v. Engineering Department, Town of South Windsor; Docket #FIC 2002-544, John C. King v. Inland Wetlands Agency/Conservation Commission, Town of South Windsor; Docket #FIC 2002-545, John C. King v. Planning Department, Town of South Windsor; Docket #FIC 2002-546, John C. King v. Planning and Zoning Commission, Town of South Windsor; Docket #2002-547, John C. King v. Town Council, Town of South Windsor; Docket #FIC 2002-548, John C. King v. Town Manager, Town of South Windsor; Docket #FIC 2002-549, John C. King v. Water Pollution Control Authority, Town of South Windsor; and Docket #FIC 2002-550, John C. King v. Zoning Board of Appeals, Town of South Windsor.

 

At the conclusion of the hearing, the parties reached a stipulated agreement in settlement of the complaint.  The parties agreed that:

 

1.  Counsel for the respondent will direct the respondent to conduct an electronic search for any emails responsive to the complainant’s request, and provide copies of any such records to the complainant.

 

2.  Counsel for the respondent will instruct the respondent to construe records requests broadly.

 

3.  The complainant will withdraw his complaint.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.  The complaint is dismissed.
