The above-captioned matter was scheduled to be heard as a contested case on October 17, 2003, at which time neither the complainant nor the respondent appeared. The complainant did not attempt to notify the Commission of his desire to withdraw the complaint until Saturday, October 18, 2003, at which time he sent an e-mail to that effect.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is dismissed for failure to prosecute.
