The above-captioned matter, which was consolidated for purposes of hearing with contested case docket #FIC 2004-005, Ralph W. Williams Jr. and The Manchester Journal Inquirer v. State of Connecticut, Office of the Governor, was scheduled to be heard as a contested case on Monday May 3, 2004. On Friday April 30, 2004, the complainants notified the Commission that they wished to have the matter postponed indefinitely due to illness of their counsel. On Monday May 3, 2004, the complainants further requested that the matter be postponed for a few weeks, however, if the Hearing Officer’s decision was to proceed with the hearing rather than postpone then they wished to withdraw the complaint without prejudice. The Hearing Officer denied the requests to postpone. Consequently, the matter was withdrawn.
Based on the above, the following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is dismissed.
