The above-captioned matter was heard as a contested case on December 15, 2003, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. At the conclusion of the hearing, the parties reached a stipulated agreement in settlement of the complaint. The parties then indicated their intention to reduce their agreement to writing and submit it to the hearing officer. The parties apparently failed to execute such an agreement.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is dismissed without prejudice.
