The above-captioned matter was scheduled to be heard as a contested case on July 12, 2004, at which time the complainant and the respondent appeared and indicated to the Commission that they reached an agreement in resolution of the complaint, whereby the respondent will provide to the complainant a copy of the Internal Affairs Investigation Report on or before July 19, 2004. Based upon this agreement the complainant withdrew the complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. In light of the above, the complaint is hereby dismissed.
2. The Commission commends the parties for working together and achieving a non-litigated resolution in this matter.
