The above-captioned matter was scheduled to be heard as a contested case on February 25, 2005, at which time the complainant and the respondent appeared and informed the Commission that they reached an agreement in resolution of the complaint.  Specifically, the respondent provided the complainant with all records responsive to his request, and the complainant withdrew the complaint.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.  Based on the above-described agreement, reached by the parties in this matter, and the withdrawal of the complaint, the case is hereby dismissed.

2.  The Commission commends the parties on having reached a non-litigated settlement in this matter.
