The above-captioned matter was heard as a contested case on February 28, 2005, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. At the conclusion of the hearing, the parties reached a settlement of the complaint on the following terms:
1. The respondent will provide incident report number 6084 within ten days of the hearing on this matter.
2. If Assistant Dean of Students Bresciano has any witness statements regarding the complainant in her possession, she will provide them within ten days of the hearing on this matter.
3. If Assistant Dean of Students Bresciano receives any witness statements regarding the complainant, she will provide them to the complainant at least ten days before any disciplinary hearing regarding the complainant.
4. If the University of Connecticut decides to use any law enforcement records in any disciplinary hearing regarding the complainant, it will provide such records to the complainant at least ten days before such hearing.
5. The respondent has no other documents responsive to the complainant’s request that it has not provided to the complainant.
6. The complainant withdraws his complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is dismissed.
2. The parties are commended on their resolution of this matter.
