The above-captioned matter was heard as a contested case on August 8, 2005, at which time the complainants and the respondent appeared and presented testimony and argument on the complaint.
Based upon receipt by the complainants of the records introduced into evidence by the respondent, the complainant withdrew his complaint in this contested case. The complainant testified that at least an email attachment and a letter previously directed to him or his office had not come to his personal attention. With this miscommunication resolved, the complainant stated that he had records sufficient to withdraw his complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
2. The Commission commends the parties on having reached a settlement without full adjudication.
