The above-captioned matter was heard as a contested case on April 11, 2005, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. The matter was consolidated for hearing with docket #FIC 2004-496, Ulrike Klueh v. Director, FOI Office, State of Connecticut, University of Connecticut Health Center; and docket #FIC 2004-463, Don Kreutzer v. Director, FOI Office, State of Connecticut, University of Connecticut Health Center. On the hearing officer’s own motion, the respondent named by the complainant has been changed to reflect the actual respondent, who personally appeared at the hearing and was represented by counsel, and the case caption has been changed accordingly.
Following the hearing, the parties reached a settlement of the complaint, pursuant to which the respondent agreed to provide the records sought by the complainant, and the complainant agreed to withdraw this complaint, reserving the right to file a new complaint should she believe that she has not received all the records she has requested.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
