The above-captioned matter was scheduled to be heard as a contested case on September 7, 2005, at which time the complainant and the respondent appeared, and reached an agreement in an attempt to resolve the complaint in this matter.
The parties agreed that if the State of Connecticut Department of Administrative Services provides the respondent with a release to disclose the records requested by the complainant in his May 9, 2005 letter to the respondent, the respondent will provide the complainant with any and all records responsive to his request to the extent such records exist and are maintained by the respondent.
Based on the agreement, the complainant informed the Commission that he wished to withdraw his complaint.
The Commission commends both the complainant and the respondent for working successfully to negotiate a settlement of this complaint.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.
1. The complaint is hereby dismissed.
