After consideration of the entire record, the following facts are found and conclusions of law are reached:
1. The respondent is a public agency within the meaning of §1-200(1), G.S.
2. By letter dated February 8, 2005, and filed on February 14, 2005, the complainant appealed to the Commission alleging that the respondent violated the Freedom of Information Act by denying him access to the 2004 audit and 2004 ledger of the Lake Zoar Authority.
3. The Commission takes administrative notice of the record in docket #FIC 2005-054, Anthony M. D’Angelo v. Board of Commissioners, Lake Zoar Authority.
4. It is found that all of the allegations in this complaint have been fully addressed in the Hearing Officer’s Report in docket #FIC 2005-054, Anthony M. D’Angelo v. Board of Commissioners, Lake Zoar Authority.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is dismissed.
