The above-captioned matter was heard as a contested case on March 21, 2006, at which time the complainants and the respondent appeared and presented exhibits and argument on the complaint. Following this initial presentation of evidence, at the suggestion of all the parties, an informal conference was held without the presence of the hearing officer.
As a result of this conference, the parties announced on the record to the hearing officer their agreement that the respondent would provide to the complainants within thirty days of the hearing, to the extent that the respondent maintains relevant records from 1994 to the present date, all information in its custody and control that is the same generally as set forth on the Department of Revenue Services First Responders Emergency Incident Reports in the record (Complainant’s Exhibit 1). Accordingly, the date, time, floor of the building, and general nature of the first responders call will be disclosed in the records provided to the complainants, but not any personally identifiable information concerning any person reporting any medical condition. Based upon this agreement entered into by the respondent, the complainants agreed to withdraw their complaint.
The Commission commends both the complainants and the respondent for practically and amicably reaching a settlement of this case, with all parties manifesting considerable sophistication concerning the Freedom of Information Act and relevant exemptions.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
