The above-captioned matter was scheduled to be heard as a contested case on March 15, 2006 and April 25, 2006, at which times the complainant and the respondent appeared to present testimony, exhibits and argument on the complaint.  For the purpose of hearing, the above-captioned case was consolidated with docket #FIC 2005-573, Richard Reynolds v. Chief, Police Department, City of Waterbury.  However, the complainant and the respondent reached an agreement that settled the complaint against the respondent Commissioner, State of Connecticut, Department of Public Safety.  By letter dated July 10, 2006, the complainant, through his counsel, informed the Commission that he wished to withdraw his complaint in the above-captioned matter only.

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.      The complaint is hereby dismissed.
