The above-captioned matter was scheduled to be heard as a contested case on July 21, 2006, at which time the complainant and the respondent appeared and indicated to the Hearing Officer that they reached a settlement in resolution of the complaint.  The complainant further indicated that he wished to withdraw the complaint.

   

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

1.      The complaint is hereby dismissed.
