The above-captioned matter was scheduled to be heard as a contested case on August 14, 2006, at which time the complainants appeared, but the respondent did not appear. The hearing was opened in order to create a record of the proceedings, including the introductory argument of the complainants. During a conference telephone call to the office of the respondent, a staff member of the respondent stated that the Captain in charge of the matter for the respondent had suffered the death of his father over the previous weekend and was attending the funeral of his father on the morning of the hearing. Accordingly, the matter was subsequently rescheduled for a continued hearing on September 26, 2006.
By a pleading filed with the Commission on September 12, 2006, the complainants withdrew their complaint in this matter. The Commission takes administrative notice of such withdrawal.
The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The Commission commends the parties on having reached a non-litigated settlement in this matter.
