The above-captioned matter was scheduled to be heard as a contested case on October 17, 2006, at which time the complainant and the respondent appeared. An introductory review of the allegations presented by the complaint and relevant law was conducted on the record. Based upon this review, the parties agreed to conduct an off the record settlement conference, without the presence of the hearing officer.
After the hearing officer was called back into the hearing room, the complainant stated on the record that he wished to “withdraw the complaint without prejudice”. The hearing officer explained that such a withdrawal would result in dismissal of the complaint, but that the complainant retained his right to make a new request and, if necessary, file a new complaint. The complainant reaffirmed his withdrawal on this basis.
The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The Commission commends the parties on having reached a non-litigated settlement in this matter.
