FREEDOM OF INFORMATION COMMISSION

The above-captioned matter was heard as a contested case on April 3, 2006, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  The petitions of Health Net of Connecticut, Inc. and Community Health Network of Connecticut, Inc. to be designated as parties were granted.

 

At the hearing, the complainant withdrew his complaint without prejudice to refile, based on his desire to await a resolution of the consolidated administrative appeals in docket numbers CV 06-4010428-S, 06-4010429-S, 06-4010430-S, 06-40099521-S, 064009522-S, and 06-4009534-S, Health Net of Connecticut et al. v. FOIC et al. (Superior Court, Judicial District of New Britain).

 

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is dismissed.
