The above-captioned matter was scheduled to be heard as a contested case on August 2, 2006, at which time the respondent appeared. The complainants, however, failed to appear at the hearing in this matter.  

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

            1.  The complaint is hereby dismissed with prejudice for failure to prosecute as the parties failed to communicate with the Commission concerning a potential settlement of the complaint.

 

            2.  The complainants are admonished for their failure to inform the Commission that they did not intend to appear at the hearing on this matter which resulted in a loss of valuable state resources.
