FREEDOM OF INFORMATION COMMISSION
OF THE STATE OF CONNECTICUT

            

The above-captioned matter was scheduled to be heard as a contested case on February 21, 2007, at which time the complainant and the respondent appeared and reached the terms of an agreement in settlement of this matter.

 

At the commencement of the hearing, the complainant and respondents reached a stipulated agreement in settlement of the complaint.  The respondents stipulated that:

 

1.  The respondent building committee failed to prepare an agenda for its October 18, 2006 meeting;

 

2.  The respondent board convened in executive session during its October 30, 2006 meeting, without properly voting to convene in executive session under the Freedom of Information (“FOI”) Act; and

 

3.  The members of the respondent board shall attend an FOI Act training session to be conducted by staff of the Commission.  The respondent board agreed to contact the Commission’s staff within two weeks from the notice of final decision in this matter to schedule such training session.

 

Based on the foregoing stipulations, the complainant withdrew his complaint.

 

            The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

            1.  The complaint is hereby dismissed.
