The above-captioned matter was heard as a contested case on February 9, 2007, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. This matter was consolidated for hearing with Docket #FIC 2006-543, David E. Garside v. Personnel Coordinator, City of New London; and City Manager, City of New London[1].
At the conclusion of the hearing in this matter, the parties reached an agreement in settlement of the complaint. Specifically, the respondents agreed to provide the complainant with copies of the requested records, with social security numbers, home addresses, and names of spouses and children redacted.
Based upon the respondents’ agreement to provide copies of the requested records, with the redactions noted above, the complainant stated that he wished to withdraw the complaint in this matter.
The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Based upon the withdrawal of the complaint, the case is hereby dismissed.
