The above-captioned matter was scheduled to be heard as a contested case on February 6, 2007, at which time the complainant and the respondent appeared.  The complainant, who is incarcerated, appeared via teleconference, pursuant to the January 2004 memorandum of understanding between the Commission and the Department of Correction. See Docket No. CV 03-0826293, Anthony Sinchak v. FOIC, Superior Court, J.D. of Hartford at Hartford, Corrected Order dated January 27, 2004 (Sheldon, J.). 

 

At the outset of the hearing in this matter, the hearing officer explained, to the complainant, that in an effort to maintain an orderly hearing it would be important for him to stay within the scope of his complaint and that if he did not, the hearing officer had the authority to terminate the hearing.  The complainant took issue with the hearing officer directing that portion of her instructions solely to him.  After a verbal exchange between the complainant and the hearing officer during which the complainant was put on notice that if order could not be maintained she had the authority to close the hearing, the complainant abruptly terminated the telephone call.  Thereafter, the hearing was closed without any presentation of evidence or testimony.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      The complaint is hereby dismissed for failure to prosecute.
