The above-captioned matter was scheduled to be heard as a contested case on March 16, 2007, at which time the respondent appeared, but the complainant did not appear due to inclement weather.
The matter was scheduled for a continued hearing on April 26, 2007, at which time both the complainant and the respondent appeared. An introductory review of the allegations presented by the complaint and relevant law was conducted on the record. Based upon this review, the complainant stated on the record that he wished to withdraw his complaint. The hearing officer explained that the complainant retained his right to make a new request and, if necessary, file a new complaint. The complainant reaffirmed his withdrawal on this basis.
The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The Commission commends the parties on having reached a non-litigated settlement in this matter.
