The above-captioned matter was heard as a contested case on February 22, 2007, at which time the complainant and the respondent appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint. 

 

At the conclusion of the hearing, the parties reached a stipulated agreement in settlement of the complaint.  The parties agreed that:

 

1.  The respondent will gather all legal bills dating from July 1, 2002 from attorneys Atherton B. Ryan, Mark R. Spurling, and Susan Boyan. 

 

2.  The respondent will arrange a room for the complainant to inspect the records by the afternoon of February 26, 2007, and will make copies if requested.

 

3.  The complainant will withdraw his complaint.

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.  The complaint is dismissed.
