The above-captioned matter was consolidated for hearing with Docket #FIC 2007-081, Clarence Jennings v. First Selectman, Town of Easton. Both matters were scheduled to be heard as contested cases on October 1, 2007, at which time both the complainant and the respondent, which were the same persons in both matters, appeared.

The parties presented testimony, extensive exhibits, including a sworn statement, and argument on the complaint. Based upon new evidence not presented in FIC 2006-228, an earlier case between the same parties, the parties stipulated that the complainant wished to withdraw his complaint.

            The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.

 

2.  The Commission commends the parties on having reached a settlement in this matter without full adjudication.
