The above-captioned matter was scheduled for hearing as a contested case on December 6, 2007, at which time both the complainant and the respondents appeared and presented testimony, exhibits and argument on the complaint. At this hearing, the complainant stated that it needed more time to review the extensive records that the respondents had provided on December 4, 2007 on a computer disc. The respondents stated that, by December 10, 2007, they would inform the complainant of the fee for obtaining additional requested records on computer disc.
The hearing officer scheduled a status conference on the case for December 20, 2007. At the commencement of the status conference, the parties announced on the record a resolution of this contested case. The complainant stipulated that, based upon the additional records that the respondents had recently provided, it was satisfied that all requested records had been provided. The respondents stipulated that: 1) they had committed various promptness violations of the Freedom of Information Act (“FOIA”); 2) they waived any claims for any outstanding fees for records provided in response to the request at issue in this case; and 3) they would co-operate fully with the complainant in the future, including addressing future FOIA requests promptly.
Based upon these stipulations, the complainant stated on the record that it wished to withdraw its complaint.
The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The Commission warmly commends the parties on having reached a non-adjudicated settlement in this complex matter involving voluminous records, many technical in nature, concerning property tax re-evaluation.
