FREEDOM OF INFORMATION COMMISSION
OF THE STATE OF CONNECTICUT

 

The above-captioned matter was scheduled for hearing as a contested case on March 19, 2008, at which time both the complainants and the respondent appeared and presented testimony, exhibits and argument on the complaint. On March 25, 2007, the respondent made a written offer of settlement to the complainants, with a copy to the hearing officer. On April 11, 2008, the complainants informed the Commission that they wished to withdraw their complaint. The Commission takes administrative notice of such withdrawal.

 

            The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.

 

2.  The Commission warmly commends the parties on having reached a non-adjudicated settlement in this matter involving voluminous records, dispersed in a variety of locations, and dated during a period from seven to twelve years ago. With the respondent in bankruptcy, an additional layer of legal process would also have been necessary if the matter required full adjudication.
