The above-captioned matter was scheduled for hearing as a contested case on February 15, 2008 and April 30, 2008, at which times both the complainant and the respondent appeared and presented testimony, exhibits and argument on the complaint. On May 20, 2008, the complainant informed the Commission that he wished to withdraw his complaint. The Commission takes administrative notice of such withdrawal.
The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The Commission warmly commends the parties on having reached a non-adjudicated settlement in this matter involving voluminous technical records concerning real estate appraisals over a period of twenty years.
