The above-captioned matter was heard as a contested case on June 9, 2008, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.
At the conclusion of the June 9, 2008, hearing, the parties jointly requested that the matter be continued for a period of three weeks, so that they might attempt settlement of the complaint. Such request was granted. A continued hearing was scheduled for June 30, 2008. However, on June 20, 2008, the complainant filed with the Commission a withdrawal of the complaint, stating that he had received all requested records. The Commission takes administrative notice of such withdrawal.
The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint:
1. The complaint is hereby dismissed.
2. The Commission commends both parties for their non-litigated settlement
of this matter.
