The above-captioned matter was consolidated for hearing with Docket # FIC 2008-099, also captioned Clark W. Stearns, First Selectman, Town of Scotland v. Superintendent of Schools, Regional School District 11. Both matters were scheduled for hearing as contested cases on June 26, 2008, at which time both the complainant and the respondent appeared and presented testimony and argument on the complaint. Following this process, the complainant informed the Commission that all remaining issues that he wished to pursue are set forth in the companion docket, Docket # FIC 2008-099, and that he therefore wished to withdraw his complaint in the above captioned matter.
The Commission takes administrative notice of the complainant’s withdrawal and recommends the following orders on the basis of the record:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The Commission warmly commends the parties on having reached a settlement in this matter without full adjudication.
