The above-captioned matter was scheduled for hearing as a contested case on August 12, 2008, at which time both the complainant and the respondent appeared and presented testimony, exhibits and argument on the complaint. Following this process, the parties agreed with each other to hold an off the record settlement conference without the presence of the hearing officer.

 

After the settlement conference, the parties stated on the record their agreement that:

 

a) Due to personnel changes, the respondent by inadvertence failed to file with the town clerk the notice and agenda for its February 20, 2008 meeting and the agenda for its March 11, 2008 meeting; the respondent acknowledges that this failure to file such materials with the town clerk was in violation of the Freedom of Information Act (“FOIA”);

 

b) The respondent regrets these errors, understands its obligation to comply with the FOIA, and has taken corrective action to ensure that all notices and agendas are timely filed with the town clerk; and

 

c) Based upon the representations of the respondent set forth in subparagraphs a) and b) above, the complainant informed the Commission that he wished to withdraw his complaint.

 

The Commission takes administrative notice of the complainant’s withdrawal and recommends the following orders on the basis of the record:

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.

2.  The Commission warmly commends the parties on having reached a settlement without full adjudication of this matter, which did not present complex issues of fact or law.
