FREEDOM OF INFORMATION COMMISSION
OF THE STATE OF CONNECTICUT

 

The above-captioned matter was consolidated for hearing with Docket # FIC 2008-299, captioned Kerry Brooks Swift v. Jerome Murphy, Selectman, Town of Brookfield. Both matters were scheduled for hearing as contested cases on August 19, 2008, at which time both the complainant and the respondent appeared and presented testimony and argument on the complaints.

 

Following this process, the respondent in the above captioned matter stipulated to the Commission that he had violated the FOIA by not providing requested records promptly. His counsel described new procedures that had been put into effect so that requested records would be provided promptly in the future. Based upon these representations, the complainant informed the Commission that she wished to withdraw her complaint in the above captioned matter.

 

The Commission takes administrative notice of the complainant’s withdrawal and recommends the following orders on the basis of the record:

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.

 

2.  The Commission warmly commends the parties on having reached a settlement in this matter without full adjudication.
