FREEDOM OF INFORMATION COMMISSION

The above-captioned matter was scheduled for hearing as a contested case on September 15, 2008, at which time both the complainant and the respondent appeared and presented testimony and argument on the complaint. Following this process, the parties agreed with each other to hold an off the record settlement conference without the presence of the hearing officer.

 

After the settlement conference, the parties presented the hearing officer with a written Stipulation and Withdrawal executed by the parties, which stated that:

 

1.      Respondent acknowledges that, by its failure to properly post the agenda for its April 21, 2008 meeting, it violated the Freedom of Information [Act] (“FOI[A]”);

 

2.      Respondent acknowledges that all discussions and decisions regarding the items to be included on the “call of the town meeting” must be conducted in public; that the final two items on said call had not been properly voted on;

 

3.      Respondent agrees to strictly comply with the requirements of the FOI[A] in the future;

 

4.      Respondent agrees to schedule and participate in an FOI[A] workshop to be conducted by the FOI Commission staff within sixty (60) days of this stipulated withdrawal (subject[ed] to the availability of the appropriate FOI Commission staff);

 

5.      Based upon the representations set forth at paragraphs 1 through 4, above, the complainant hereby agrees to withdraw his complaint in Docket #FIC 2008-352.

 

 

 

The Commission takes administrative notice of the complainant’s withdrawal and recommends the following orders on the basis of the record:

 

1.      Based on the withdrawal of the complaint, the case is hereby dismissed.

 

2.  The Commission warmly commends the parties on having reached a settlement in this matter without full adjudication.
