The above-captioned matter was heard as a contested case on September 15, 2008, at which time the complainant and the respondent appeared, and stated on the record that they had reached a stipulation in settlement of this matter, as follows:
1. Firefighter Michael Strehan shall return to work effective September 20, 2008;
2. Firefighter Strehan shall remain on probation as set forth on Schedule A attached to the stipulation;
3. Firefighter Strehan shall return to the Fire Academy in February, 2009, or when next scheduled;
4. The above-referenced complaint is withdrawn;
5. All pending grievances filed in connection with or related to the subject of the above-captioned matter are withdrawn;
6. Firefighter Strehan shall withdraw his pending workers’ compensation claim for wrongful termination/discrimination;
7. The Board of Fire Commissioners will comply with Freedom of Information laws.
The following orders by the Commission are hereby recommended on the basis of the record concerning the above-captioned complaint:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The Commission commends the parties on having reached a non-litigated settlement in this matter.
