The above-captioned matter was heard as a contested case on April 29, 2008, at which time the complainant and the respondents appeared, stipulated to certain facts and presented testimony, exhibits and argument on the complaint.  James Bettcher, one of the subjects of the records at issue, testified at the hearing as a witness. 

After consideration of the entire record, the following facts are found and conclusions of law are reached:

1.  The respondents are public agencies within the meaning of §1-200(1), G.S.

 

2.      It is found that, by letter dated November 18, 2007, the complainant made a request to the respondents for a copy of the following records: “any/all arrest reports/incident reports for the following individuals during their employment with the Dept. of Correction.  Even if their cases were Nolle/dismissed. . . .”  The complainant then listed the following ten individuals and indicated the date of the record or the type of record she was interested in obtaining:  Thomas Cummings, March 23, 2005; Rafael Palacio, August 14, 1987; Emmit Riddick, most recent arrest July 19, 2005; Virginia Ellis-Golemba, written reprimand; Kevin Sckulczyck, June 21, 2001 and March 18, 2007; John Frazier, arrested three times; Hector Hernandez, several arrests; Jose Rodriguez, arrested May 6, 2006; James Bettcher, March 9, 2003 and July 5, 2003; and Correction Officer David Gibson, May 19, 2001. 

 

3.      It is found that, by letter dated November 28, 2007, the respondents acknowledged the complainant’s request for records, and stated that the Human Resources Department would begin to process the request. 

4.      It is found that, after a review of the records described in paragraph 2, above, the respondents believed that release of such records would legally constitute an invasion of personal privacy and, accordingly, the respondents provided the ten named individuals with an opportunity to object to the disclosure of such records. 

 

5.      It is found that, by letter dated February 13, 2008, the respondents notified the complainant that the following six individuals had objected to the release of their records:  Rafael Palacio; Hector Hernandez; Thomas Cummings; James Bettcher; David Gibson; and Virgina Ellis-Golemba.  The respondents, therefore, denied the complainant’s request with respect to these six individuals.  The respondents further informed the complainant that they would continue to process the complainant’s request with respect to the four individuals that did not object. 

 

6.      By letter dated December 3, 2007 and filed December 5, 2007, the complainant appealed to this Commission, alleging that the respondents violated the Freedom of Information (“FOI”) Act by denying her request for the records described in paragraph 2, above. 

 

7.      It is found that, prior to the hearing in this matter, the respondents provided the complainant with the records that she requested with regard to John Frazier and Jose Rodriguez.  At the hearing, the parties agreed that the record with regard to Mr. Frazier and Mr. Rodriguez are no longer at issue in this matter. 

 

8.      Section 1-200(5), G.S., provides:

 

“Public records or files” means any recorded data or information relating to the conduct of the public’s business prepared, owned, used, received or retained by a public agency, or to which a public agency is entitled to receive a copy by law or contract under section 1-218, whether such data or information be handwritten, typed, tape-recorded, printed, photostated, photographed or recorded by any other method.

 

9.      Section 1-210(a), G.S., provides in relevant part that:

 

Except as otherwise provided by any federal law or state statute, all records maintained or kept on file by any public agency, whether or not such records are required by any law or by any rule or regulation, shall be public records and every person shall have the right to . . . (3) receive a copy of such records in accordance with section 1-212.

 

10.   Section 1-212(a), G.S., provides in relevant part that “[a]ny person applying in writing shall receive, promptly upon request, a plain or certified copy of any public record.”

 

11.   It is found that the respondents maintain the records described in paragraph 2, above, and it is therefore concluded that such records are “public records” and must be disclosed in accordance with §§1-210(a) and 1-212(a), G.S., unless they are exempt from disclosure. 

 

12.   At the hearing on this matter, the respondents argued that the records they have withheld are permissibly exempt from disclosure based on the provisions of the State’s erasure statutes. 

 

13.   Section 54-142a(c), G.S., provides in relevant part that:

 

(c) [w]henever any charge in a criminal case has been nolled in the Superior Court, or in the Court of Common Pleas, if at least thirteen months have elapsed since such nolle, all police and court records and records of the state’s or prosecuting attorney or the prosecuting grand juror pertaining to such charge shall be erased.

 

14.   Section 54-142c, G.S., provides in relevant part that:

 

(a) [t]he clerk of the court or any person charged with retention and control of erased records . . . or any criminal justice agency having information contained in such erased records shall not disclose to anyone the existence of such erased records or information pertaining to any charge erased under any provision of this part, except as otherwise provided in this chapter.  (emphasis supplied)


(b) [n]otwithstanding any other provisions of this chapter, within two years from the date of disposition of any case, the clerk of the court or any person charged with the retention and control of erased records . . . or any criminal justice agency having information contained in such erased records may disclose to the victim of a crime or the victim’s legal representative the fact that the case was dismissed.  If such disclosure contains information from erased records, the identity of the defendant or defendants shall not be released, except that any information contained in such records, including the identity of the person charged may be released to the victim of the crime or the victim’s representative upon written application by such victim or representative to the court stating (1) that a civil action has been commenced for loss or damage resulting from such act, or (2) the intent to bring a civil action for such loss or damage.

 

15.   Pursuant to §54-142g(b), G.S., and for purposes of 54-142c, G.S., a “criminal justice agency” is defined as including “any . . . government agency created by statute which is authorized by law and engages, in fact, as it principal function in activities constituting the administration of criminal justice, including, but not limited to, . . . the Department of Correction . . . .”

16.   It is therefore concluded that the Department of Correction is a criminal justice agency for purposes of the erasure provisions of §54-142c, G.S.

17.   It is further concluded that the erasure provisions of §§54-142a and 54-142c, G.S., supercede the disclosure requirements of the FOI Act and that any of the requested records subject to the erasure statutes are not required to be disclosed. 

18.  The respondents’ representative testified that she reviewed the records responsive to the complainant’s request with regard to Thomas Cummings, Rafael Palacio, Virginia Ellis-Golemba, Kevin Sckulczyck, Hector Hernandez, and David Gibson.  She further testified that with respect to some of these individuals she discovered no responsive records and with regard to other individuals she discovered information pertaining to charges of arrest, which had been nolled.  She further testified that more than thirteen months had elapsed since the entry of such nolles. 

19.  Based on the respondents’ testimony, it is found that the following six individuals either had no records responsive to the complainant’s request or had records that were exempt from disclosure pursuant to the provisions §§54-142a and 54-142c (a) and (b), G.S.:  Thomas Cummings, Rafael Palacio, Virginia Ellis-Golemba, Kevin Sckulczyck, Hector Hernandez, and David Gibson.

20.   It is concluded that, pursuant to the erasure provisions of §§54-142a(c) and 54-142c, G.S., the respondents did not violate the disclosure provisions of §§1-210(a) and 1-212(a), G.S., by denying the complainant’s request for records pertaining to the six individuals identified in paragraph 19, above. 

21.   It is concluded that only the records remaining at issue in this case are those pertaining to Emmit Riddick and James Bettcher.

22.   With regard to Mr. Riddick, the respondents testified that they provided the complainant with a copy of the record pertaining to Mr. Riddick’ arrest on July 19, 2005 because this was the record that the complainant specifically identified in her records request, as described in paragraph 2, above. 

23.   The respondents further testified that, while they located an additional record pertaining to Mr. Riddick, they did not disclose said record to the complainant because they construed complainant’s request as seeking only the record specifically identified by the complainant in her request.  The respondents further testified, however, that the additional record pertaining to Mr. Riddick is not subject to the erasure provisions of §§54-142a and 54-142c, G.S.

24.   It is found that, while the complainant did specifically request Mr. Riddick’s “most recent arrest [record dated] July 19, 2005,” she also made a general request for any and all records pertaining to the listed individuals, which included Mr. Riddick.

25.   Because Mr. Riddick did not object to the disclosure of his records, and because this additional record is the same kind of record as was specifically identified by the complainant, it is found that this additional record falls within the purview of the complainant’s records request. 

 

26.   Nonetheless, it is found that, given the structure of the complainant’s request for records and the number of records specifically identified in the records request, the respondents’ construction of the complainant’s request for records, as referenced in paragraph 23, above, was reasonable. 

 

27.   It is therefore concluded that, by providing the complainant with only a copy of Mr. Riddick’s July 19, 2005 arrest record, the respondents did not violate the disclosure provisions of  §§1-210(a) and 1-212(a), G.S., with regard to the complainant’s request for records pertaining to Mr. Riddick. 

 

28.   Finally with regard to Mr. Bettcher’s records, Mr. Bettcher testified at the hearing that he was familiar with the records in question pertaining to him, that the records constituted part of his Department of Correction personnel file within the meaning of §1-210(b)(2), G.S., and that disclosure of these records would constitute an invasion of his personal privacy. 

 

29.  Subsequent to the hearing in this matter, the respondents submitted the records pertaining to Mr. Bettcher to the Commission for an in camera inspection (hereinafter the “in camera records”).

 

30.  The in camera records consist of two packages of records consisting of thirty pages in total.  The in camera records shall be identified as IC-2007-659-1 through IC-2007-659-27 (package one) and IC-2007-659-28 through IC-2007-659-30 (package two). 

31.   Section 1-210(b)(2), G.S., provides in relevant part that nothing in the FOI Act shall require disclosure of “. . . personnel or medical files and similar files the disclosure of which would constitute an invasion of personal privacy . . . .”

 

32.   The Supreme Court set forth the test for the exemption contained in §1-210(b)(2), G.S., in Perkins v. Freedom of Information Commission, 228 Conn. 158, 175 (1993).  The claimant must first establish that the files in question are personnel, medical or similar files.  Second, the claimant must show that disclosure of the records would constitute an invasion of personal privacy.  In determining whether disclosure would constitute an invasion of personal privacy, the claimant must establish both of two elements: first, that the information sought does not pertain to legitimate matters of public concern, and second, that such information is highly offensive to a reasonable person.  The Commission takes administrative notice of the multitude of court rulings, Commission final decisions (Endnote 1), and instances of advice given by the Commission and staff members (Endnote 2), which have relied upon the Perkins test, since its release in 1993.

 

33.   Section 1-214, G.S., provide in relevant part that:

 

(b) Whenever a public agency receives a request to inspect or copy records contained in any of its employees’ personnel or medical files and similar files and the agency reasonably believes that the disclosure of such records would legally constitute an invasion of privacy, the agency shall immediately notify in writing (1) each employee concerned, provided such notice shall not be required to be in writing where impractical due to the large number of employees concerned and (2) the collective bargaining representative, if any, of each employee concerned.  Nothing herein shall require an agency to withhold from disclosure the contents of personnel or medical files and similar files when it does not reasonably believe that such disclosure would legally constitute an invasion of personal privacy.

 

(c) A public agency which has provided notice under subsection (b) of this section shall disclose the records requested unless it receives a written objection from the employee concerned or the employee’s collective bargaining representative, if any, within seven business days from the receipt by the employee or such collective bargaining representative of the notice or, if there is no evidence of receipt of written notice, not later than nine business days from the date the notice is actually mailed, sent, posted or otherwise given.  Each objection filed under this subsection shall be on a form prescribed by the public agency, which shall consist of a statement to be signed by the employee or the employee’s collective bargaining representative, under the penalties of false statement, that to the best of his knowledge, information and belief there is good ground to support it and that the objection is not interposed for delay.  Upon the filing of an objection as provided in this subsection, the agency shall not disclose the requested records unless ordered to do so by the Freedom of Information Commission pursuant to section 1-206.

34.   It is found that the respondents timely notified Mr. Bettcher of the request at issue in the matter, and that Mr. Bettcher timely filed an objection to the disclosure of the records pertaining to him, within the meaning of §1-214, G.S.

 

35.   It is found that the in camera records listed in paragraph 30, above, constitute a “personnel” or “similar” file within the meaning of §1-210(b)(2), G.S.

 

36.   Mr. Bettcher testified at the hearing that he believed that disclosure of the records pertaining to him would constitute an invasion of his personal privacy because such records contain information pertaining to his family and private life.  He further testified that the records specifically concerned a divorce and children, and that the records have nothing do with his employment at the Department of Correction. 

 

37.   After a careful review of the in camera records, however, it is found that such records contain information that pertains to conduct that reflects on Officer Bettcher’s decision-making and conduct while off duty, but do not pertain to private family matters. 

 

38.  Due to the nature of the incidents described in the records identified in paragraph 30, above, it is found that the records pertain to legitimate matters of public concern.  It is further found that the disclosure of such information would not be highly offensive to a reasonable person.

 

39.  It is found that the disclosure of the records described in paragraph 30, above, would not constitute an invasion of personal privacy, within the meaning of §1-210(b)(2), G.S.  It is concluded that such records are not exempt from disclosure by virtue of said provision.

 

40.  Section 1-210(b)(3)(B), G.S., permits the nondisclosure of:  “[r]ecords of law enforcement agencies not otherwise available to the public which records were compiled in connection with the detection or investigation of crime, if the disclosure of said records would not be in the public interest because it would result in the disclosure of . . . signed statements of witnesses.”

 

41.  It is found that IC-2007-659-15 through IC-2007-659-16, and IC-2007-659-26 through IC-2007-659-27 are signed statements of witnesses, within the meaning of §1-210(b)(3)(B), G.S.

 

42.   Based on the foregoing, with the exception of the records identified in paragraph 41, above, it is concluded that the respondents violated the disclosure provisions of §§1-210(a) and 1-212(a), G.S., by denying the complainant’s request for the records pertaining to James Bettcher. 

 

The following order by the Commission is hereby recommended on the basis of the record concerning the above-captioned complaint.

 

1.  The respondents shall forthwith provide the complainant with a copy of IC-2007-659-1 through IC-2007-659-14; IC-2007-659-17 through IC-2007-659-25; and IC-2007-659-28 through IC-2007-659-30, free of charge. 

2.  Consistent with Commission precedent, the respondents may redact social security numbers from the records, prior to providing such records to the complainant.

 

3.  Henceforth, the respondents shall strictly comply with the provisions of §§1-210(a), 1-212(a) and 1-214(b), G.S.

 

            4.  The Commission requests that the respondents provide the complainant with a copy of the additional record identified in paragraph 23, above, free of charge.

AFFIDAVIT OF ERIC V. TURNER

 

Eric V. Turner, having been duly sworn, does hereby depose as follows:

 

1.  I am over the age of eighteen (18) years and understand the obligation of an affirmation.

 

2.  I am a member of the Connecticut Bar and am currently employed as Director of Public Education for the Connecticut Freedom of Information Commission, having first been employed by said commission in 1996.

 

3.  I am providing this affidavit in light of the Supreme Court decision in Director, Retirement & Benefits Services Division v. Freedom of Information Commission, 256 Conn. 764 (2001), in which the court apparently invites a reconsideration of Perkins v. Freedom of Information Commission, 228 Conn. 158 (1993).  See, Director, supra at 782, fn 13, 785 (Zarella, J. concurring).

 

4.  As part of my responsibilities as Director of Public Education for said commission, I have developed, organized and scheduled speaking engagements, seminars and programs explaining the duties and rights established under the Connecticut Freedom of Information Act.

 

5.  Since I assumed my current position in 1996, there have been approximately 290 such speaking engagements, seminars and programs in Connecticut and I have personally lectured in approximately 80 such speaking engagements, seminars and programs.

 

6.  As part of the presentation I have prepared for such speaking engagements, seminars and programs, the subject of the Connecticut General Statues Section 1-210(b)(2) exemption for personnel, medical and similar files the disclosure of which would constitute an invasion of personal privacy is stressed because of the great interest in that exemption and the confusion generated by a series of inconsistent and contradictory court decisions prior to Perkins, supra.  See, e.g., Chairman v. Freedom of Information Commission, 217 Conn. 193 (1991) (establishing “reasonable expectation of privacy” test; query whether subjectively or objectively applied) and Board of Education v. Freedom of Information Commission, 210 Conn. 590 (1989) (confirming a “balancing” test), which was overruled by the Chairman case.

 

7.  Since the Supreme Court ruling in Perkins, supra, all Freedom of Information Commission staff members who conduct such speaking engagements, seminars and programs discuss in detail the rulings in that case and its progeny.

 

8.  As part of my responsibilities as Director of Public Education, I also answer telephone and other inquiries from public officials and the public.  Since my employment with said commission, I have answered thousands of such inquiries, including hundreds of inquiries concerning the Connecticut General Statutes Section 1-210(b)(2) exemption.  In responding to such inquiries I discuss in detail the Perkins case and its progeny.

 

9.  Based on the foregoing experiences, it is my opinion that the Perkins decision, and its progeny, have had a beneficial effect on public officials and the public itself because they can rely on a now long-standing and clear test with respect to the Connecticut General Statutes Section 1-210(b)(2) exemption, which helps them determine whether that exemption is applicable to the practical problems they encounter with respect to personnel, medical and similar information.  Indeed, the many court and Freedom of Information Commission decisions applying the Perkins test have given public officials and the public a now consistent body of law concerning that statutory exemption.
