The above-captioned matter was scheduled for hearing as a contested case on November 4, 2008, at which time both the complainant and the respondents appeared and presented testimony, exhibits and argument on the complaint. Following this process, the parties agreed with each other to hold an off the record settlement conference without the presence of the hearing officer.
After the settlement conference, the parties presented the hearing officer with a proposed settlement, which included the following terms:
1) The Recording Secretary of the Winchester Board of Education will be the Freedom of Information Act Liaison for the respondent Winchester Public Schools.
2) The respondent Superintendent shall be responsible for complying with the Freedom of Information Act on behalf of the respondent Winchester Public Schools.
3) The complainant is, at present, a member of the Winchester Board of Education, and has filed frequent, sometimes voluminous, records requests. Before the complainant files future complaints with the Commission concerning records requests, the complainant shall contact the respondent Superintendent by telephone and, if necessary, in writing. The respondents shall respond promptly to all of the complainant’s records requests, but the respondent Superintendent shall not in any case respond later than thirty days following a contact by the complainant as described in this paragraph.
4) The respondents affirm that they have no further records within the scope of the complainant’s request in this matter, having previously delivered a one-page record that did not exist at the time of the records request.
5) Based upon these representations, the complainant informed the Commission that she wished to withdraw her complaint in the above captioned matter.
The Commission takes administrative notice of the complainant’s withdrawal and recommends the following orders on the basis of the record:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The Commission warmly commends the parties on having reached a settlement in this matter without full adjudication.
