The above-captioned matter was heard as a contested case on January 22, 2009, at which time both the complainant and the respondents appeared and presented testimony, exhibits and argument on the complaint.
Following this process, the complainant informed the Commission that she wished to withdraw her complaint in the above captioned matter.
The Commission takes administrative notice of the complainant’s withdrawal and recommends the following orders on the basis of the record:
1. Based on the withdrawal of the complaint, the case is hereby dismissed.
2. The hearing served a valid purpose for the complainant to establish that the records the respondents provide encompass all of the records that the respondents maintain which are within the scope of the complainant’s request. With this accomplished, the Commission warmly commends the parties on having reached a settlement in this matter without full adjudication.
